The Association of State Wetland Managers is a nonprofit membership organization established in 1983 to promote and enhance protection and management of wetland resources, to promote application of sound science to wetland management efforts and to provide training and education for our members and the public. Membership is open to anyone who is involved with wetland resources.

Agenda:

1. Approve annual pay raises and addition of 6 paid holidays for staff (separate note on this sent to officers)

  • Jeanne proposed a 50 cent/hour raises to Leah Stetson, Sharon Weaver, Steve Palmer, Will and $1/hour raise to Laura Burchill – most folks work between 25-30 hours per week.
  • Jeanne proposed 6 holiday days paid for staff – Board will assist Jeanne with policy of how to implement holiday pay prorated based on the number of hours they work per week based on the previous calendar year.  This would not apply to contract staff.  Peg suggests cutting off holiday pay for folks that work 20 hours or less per week on average.
  • Financially Jeanne feels there is funding for pay raises and holiday pay.
  • Unanimous support by all on call.

2. CWA jurisdiction  - EPA and the Corps are likely to ask us to talk to ASWM about the specific concerns raised in the joint comment letter, in particular about appropriate limits to jurisdiction of ephemeral streams.  ASIWPCA is gathering some examples of their concerns.  We may want to put some forward as well.

  • ASWM letter sent via email to Board is securing final co-signatories (eight other organizations) and should be sent prior to the comment deadline date.  This is the first time this many non-profit organizations have signed on a CWA comment letter and ASWM was instrumental in making this happen.  Thanks so much for all your work!
  • Jeanne has been talking with Dave Evans, Steve Samuels. ECOS, ASEWPCA and other groups will likely be asked to sit down with EPA to have discussion on comments (i.e. bed/bank determinations and extending jurisdiction to uplands, etc.) The Environmental Council of States (ECOS) has had some sticking points on interpretation of guidance. ASWM will need good examples from the states of issues and what methodologies/tools should be included to better identify streams.  Suggestions would need to stand the test of time if placed in a rule.
  • Mary Ann shared that New Mexico’s jurisdiction is based on minimum storm flow (not base flow) of 5cfs in ephemeral streams.  A question is how does one determine how far up jurisdiction goes in a stream.  What about the variation between the wetter east and the arid west?
  • The COE has indicated that ~60% of applicants are waiving jurisdiction determination at the onset of a permit application, so it is not clear what the issues may be with jurisdiction.
  • Please forward any issues or concerns states have to Jeanne so she can share in meetings with EPA/COE and other state NGOs.

3. Winter meeting - brainstorm on agenda -The Winter meeting is scheduled for March 13-15.  It is time to start thinking about the agenda.

  • Will again be in Shepherdstown at NCTC.

4. Board only web page - we have added a Board members only section to our website. We will talk about what is on there and how to access it.

  • This is a password protected site. Historically there has been some difficultly with folks receiving attachments on the Yahoogroups listserve – to solve this issue this new page for Board members will contain these attachments.
  • To find the password protected pages, go to aswm.org, select ASWM Board and then you need to log-in to access information.  Jeanne will resend directions again so folks will be able to log-in.

5. American Rivers has asked ASWM to send a letter endorsing Rebecca Wodder as Assistant Secretary for Fish, Wildlife and Parks

  • Jeanne provided a basic background of Rebecca as a leader in conservation.  At this point it is not clear if the nominations will be confirmed if there are not enough votes in from the Senate??
  • Jeanne indicated ASWM doesn’t have a historic working relationship with Rebecca Wodder.  ASWM would be taking a political position on a nomination, which ASWM has done occasionally – Jeanne indicates she doesn’t think there is a down side to endorsing.  Dave asked about the upcoming House appropriations and possible negative impact to ASWM if we endorse Rebecca Wodder – Jeanne doesn’t think it would matter.  A positive would be if Rebecca would be selected and the endorsement might help establish a positive relationship with ASWM and her.
  • Dave Fowler asked if Jeanne saw email from Heartland Group supporting Rebecca. It raised a flag with the floodplain folks.
  • Board gives Jeanne permission to use her best professional judgment.  Mary Ann suggests to Google her and Jeanne has requested bio from American Rivers on her.

  • As of August 1st Eric Stockdale and Amy Loundes will be on the Board.
  • Janet Morlan will be our liaison with PSWS

Agenda Items:

1.  Approval of 2011 Budget

  • Jeanne provided a copy of the budget.
  • Board voted to pass budget – all members voted in favor of budget
  • ASWM will continue to build Foundation relationships over a period of years (Northwest, Wallace Fund, Waste Management, Inc.) to secure funding
  • ASWM currently has good funding for 2011 and 2012 to produce the products in our grants and contracts while also maintaining existing staff.
  • Need to add a webinar service at a cost $70/month.
  • Continue to hold membership dues (~$180,000) in reserve in case of emergency.  Cost is ~$30,000 a month to run ASWM.

2.  Adoption of 2 policies per ASWM audit and new form 990

a. Policy for determining compensation indicates current salary for CEO is not high when compared to similar state associations. It is substantially lower than other CEOs.

b. Draft annual conflict of interest disclosure form was distributed for review.

  • Jeanne indicated she would like to provide health insurance to ASWM employees before addressing any raise in CEO salary
  • Taxes due May 18th
  • Board needs to sign conflict of interest disclosure form

3.  Member at large elections FY11

  • Need a total of 5 at-large members on the board – already short one person and Janet Morlan is retiring.
  • Dave Davis made an announcement at the conference, ASWM is seeking interested persons to serve on the ASWM Board

4.  Addition of ex officio members

  • Need to clarify roles of ex officio members and recruit new members – Dave Davis made an announcement at the conference for those interested
  • Suggestion made to outline the roles/duties of an ex officio board member and length of service, etc.
